Letting a property comes with a number of legal obligations designed to protect you and your tenants. At Sable & Stone, we guide you through every requirement to ensure your property is fully compliant before and during a tenancy.

1. Gas Safety Certificate (CP12)

If your property has gas appliances, you must provide a valid Gas Safety Certificate, renewed annually. A copy must be given to tenants at the start of the tenancy and kept on file.

2. Electrical Safety Standards (EICR)

Landlords must have a certified Electrical Installation Condition Report (EICR) carried out at least every 5 years. Any remedial work must be completed promptly and evidence retained.

3. Energy Performance Certificate (EPC)

An EPC is legally required for all rental properties and must be rated E or above (unless exempt). It is valid for 10 years and must be available before marketing begins.

4. Smoke & Carbon Monoxide Alarms

You must ensure:

  • A working smoke alarm on every storey
  • A carbon monoxide alarm in any room with a solid fuel–burning appliance
  • Alarms are tested and confirmed working on the first day of the tenancy

5. Right to Rent Checks

Landlords are legally required to check that every adult tenant has the right to rent in the UK. This includes verifying official documents and keeping secure evidence of checks.

6. Deposit Protection

If you take a deposit, it must be protected in an approved Tenancy Deposit Scheme (TDS) within 30 days of receipt. Tenants must receive prescribed information confirming where and how their deposit is held.

7. How to Rent Guide

You must provide tenants with the latest version of the Government's "How to Rent" guide at the start of the tenancy. This must be given in digital or printed form.

8. Legionella Risk Assessment

Landlords must assess the property for legionella risk and ensure water systems are safe. A formal certificate isn't always required, but evidence of assessment and ongoing management is essential.

9. HMRC & Mortgage Consent

If applicable, landlords must:

  • Notify their mortgage lender for permission to let
  • Declare rental income to HMRC
  • Comply with any licensing requirements for Houses in Multiple Occupation (HMOs)

10. Selective Licensing / Local Authority Requirements

Some areas require selective landlord licences. We check local council rules and ensure all necessary licences are obtained before tenancy.

11. Repairs & Maintenance Obligations

Landlords must keep:

  • The structure and exterior in good repair
  • Heating, hot water, and electrics in working order
  • Installations for sanitation in safe condition

These are legal responsibilities under the Landlord and Tenant Act and the Homes (Fitness for Human Habitation) Act.

12. Data Protection (GDPR)

As a landlord, you must handle tenant information securely and in accordance with data protection legislation, especially if self-managing.
